כתב ויתור ופטור מאחריות – ׳רעבים בלונדון׳ – סיור קולינרי

בחרתי להשתתף מרצוני החופשי בסיור טעימות הכולל מזון ומשקאות ״רעבים בלונדון״ (להלן ״סיור״) המאורגן על ידי ׳רעבים בלונדון׳ / Hungry In London / עומר לוגסי (״המדריך״ או ״המארגן״). אני מתחייב/ת בזאת כי השתתפותי בסיור הינה על אחריותי בלבד, ואני מוותר/ת ופוטר/ת בזאת מראש את מארגן / מדריך הסיור או מי מטעמו מכל אחריות לכל נזק ו/או אובדן לגוף ו/או לרכוש אשר ייגרם לי או למקורבי המשתתפים איתי בסיור. אני מודע/ת לחלוטין לסיכונים הכרוכים בהשתתפותי בסיור זה, ומקבל/ת על עצמי את האחריות המלאה לכל מקרה של נזק, פגיעה בגוף או ברכוש, לרבות נזק כלשהו כתוצאה מאכילת מזון או שתיה, תגובות אלרגיות, פציעות, תאונות, משתתפים אחרים, נזק לרכוש, אבדן או גניבה של רכוש, פגיעה מכלי רכב, הרעלת מזון, כל מכשול שהוא, פציעה או מוות. ההשתתפות שלי בסיור היא על אחריותי בלבד ואני מוותר בזאת וויתור מלא סופי ומוחלט על כל עילת תביעה היכולה להיות לי כלפי המדריך או מי מחברי הקבוצה בגין כל נזק, גופני או ממוני, שעלול להיגרם לי או לאחר, עקב או במהלך הפעילות.

עצם הגעתי והשתתפותי בסיור זה ו/או הסכמה לאמור במסמך זה, מאשרים את הויתור על תביעה או טענה עתידית, ואת העובדה שאני משחרר את המדריך / המארגן מכל אחריות או חובה, ו/או מי מיורשיו, נציגים משפטיים, מנהלים ו/או משתפי פעולה עסקיים מכל חובה בגין כל נזק, אובדן או פגיעה לעצמי או לרכוש שלי כתוצאה מהשתתפותי בפעילות זו. אני מאשר שקראתי מסמך זה ואני מבין את תוכנו היטב, בעברית ו/או באנגלית. הסכמתי לכתב ויתור זה מוכיחה כי הבנתי את תוכן המסמך ואת כוונותיו. אני מודע לעובדה שמסמך זה פוטר מאחריות משפטית את מדריך הסיור ומי מטעמו ואני מאשר את מסמך זה מרצוני החופשי מתוך כוונה להשתתף בסיור על אחריותי בלבד.

הריני לאשר כי:

1. קראתי מסמך זה ביסודיות והבנתי את תוכנו
2. אני חותם על מסמך זה מרצוני החופשי ומודע לכך שהשתתפותי בסיור מותנית בחתימה עליו.
3. כתב ויתור זה הוא למעשה ויתור על כל טענה או תביעה עתידית שעלולה להיות לי בשל כל נזק לגוף או לרכוש כתוצאה מהשתתפותי בסיור ו/או בפעילות זו.
4. אני מודע/ת לחלוטין כי עצם השתתפותי בסיור זה, מרצוני החופשי, עלולה לחשוף אותי לסיכונים הקשורים במזון, ולכן אני לוקח/ת אחריות מלאה ומסכים/ה לפטור את המדריך/ספק הסיור מכל אחריות לנזק ו/או אובדן שעלול להיגרם לי במהלך ו/או אחרי הסיור.

אני מאשר/ת שקראתי את המסמך הזה והבנתי את תוכנו. אני מודע לכך שמדובר בכתב ויתור ופטור מאחריות והעובדה כי סימנתי שהבנתי את תוכן המסמך בעת הרישום לסיור היא עדות לכך שאני מסכים/ה לקחת על עצמי את האחריות המלאה לכל נזק או לאובדן, לגוף או לרכוש, שעלול להתרחש בסיור.

Waiver and Release of Claims – “Hungry in London” Food Tour

I am voluntarily taking part in the food and beverage tastings and walking tour “Hungry in London” (the “Tour”) provided by “Hungry in London” / Omer Lugassi (the “Tour Provider”). In consideration of participating in the Tour, on behalf of myself, my heirs and representatives, I am agreeing to release from all liability and further agreeing not to sue “Hungry in London” and/or the Tour provider/s, its employees, contractors, agents, owners, vendors, business participants and all those connected with it from any and all claims, including claims of negligence, resulting in any physical (including death) or psychological injury or damage, including any sort of food poisoning and allergic reaction(s), illness, accidents, damages or economic or emotional loss which I or any of the people who joined this tour with me may suffer as a result of my or their participation in the Tour including traveling or walking involved in the Tour.

 I am aware of the risks involved in the Tour and fully understand and accept each and every one of the risks associated with my participation in the Tour encompassing, without restriction, exposure to conditions of inclement weather, food sickness or allergic reaction(s), injuries (e.g., without exception, those arising out of lack of coordination, clumsiness or inattention, other participants, motor vehicles, pedestrians and any other possible obstacle) and death. My participation in the tour is at my own sole risk. I understand this Waiver and Release of Claims encompasses the complete agreement and acknowledgment between Participant and the Released Parties, and terminates, cancels and supersedes any previous agreement or understanding relative to the subject matter contained within.

By participating and/or signing this document, I confirm that I release “Hungry in London” and Omer Lugassi from any responsibility or liability and that there are no agreements other than what are described in this Waiver and Release of Claims. I hereby waive, release, and discharge the Tour Provider (Omer Lugassi) and his heirs, legal representatives, administrators, and executors for all liability for or by reason of any damage, loss or injury (including death) to myself or my property which has been or may be sustained as a result of my participation in the activity, and notwithstanding that such damage, loss or injury may have been caused solely or partly by the Tour Provider’s negligence.

I hereby acknowledge the following:

1. I have read this Release thoroughly and fully understand it.
2. I am voluntarily executing this Release, and would not otherwise be permitted to participate in this activity.
3. This release restricts me from suing or otherwise claiming against the Release, presently or at any future time, for damage, loss, or injury that may occur to myself or my property as a result of participating in this activity.
4. And I am completely aware that taking part of this food tour may expose me to food-related risks, and therefore I take full responsibility, and I am agreeing to release the Tour Provider / Tour Guide from all liability or any claims that are related to my food allergy or any other damage that may occur during or after the Tour.

I CONFIRM THAT I HAVE READ THIS DOCUMENT AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A WAIVER AND WAIVER OF LIABILITY, AND THE FACT THAT I AGREED TO THE TERMS OF THIS DOCUMENT INDICATES THAT I FULLY UNDERSTOOD ITS CONTENTS. BY REGISTERING FOR THIS TOUR I CONFIRM THAT I AGREE TO TAKE FULL RESPONSIBILITY FOR ANY DAMAGE OR LOSS TO THE BODY OR PROPERTY THAT MAY OCCUR DURING THE TOUR.
